# Terms of Service > Effective Date: July 26, 2025 - **Canonical page:** https://botico.ai/terms-of-service/ These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and the corporation registered in British Columbia, Canada ("Company," "we," "us," or "our"), governing your access to and use of the Botico.ai website (https://botico.ai), mobile application, and all related services, features, content, and offerings (collectively, the "Services"). Botico.ai is a trademark of the Company. By accessing, registering for, downloading, or otherwise using the Services, you affirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use immediately. The Services are provided solely for informational, educational, and automation purposes in connection with trading activities, with an initial emphasis on cryptocurrency markets via integrations such as Binance, while the underlying algorithms are architected to facilitate expansion to multi-asset classes including equities, foreign exchange, and decentralized finance protocols (currently in development). The Company does not act as a broker-dealer, investment advisor, custodian of funds, or exchange, and nothing herein constitutes financial, investment, tax, or legal advice. All trading involves substantial risk of loss, and past performance (including simulations or backtests) is not indicative of future results. ## 1. Eligibility and Capacity You represent that you are at least eighteen (18) years of age or the age of legal majority in your jurisdiction, and possess full legal capacity to enter into these Terms. Your use must comply with all applicable laws, including anti-money laundering statutes under the Proceeds of Crime (Money Laundering) and Terrorist Financing Act (Canada) and equivalent international frameworks. EU users acknowledge additional obligations under the GDPR. ## 2. Account Creation and Security Obligations Registration requires accurate, complete, and current information. You are solely responsible for the confidentiality and security of your account credentials, including API keys integrated with third-party exchanges. Report any suspected breach to support@botico.ai. API integrations confer a limited, revocable, non-exclusive license to execute trades on your behalf under trading-only permissions. ## 3. Payment Provisions and Subscription Framework The Services include a complimentary tier with restricted functionality and premium subscriptions billed on a recurring basis via secure third-party processors. Charges are non-refundable except as mandated by law or for material Service unavailability exceeding forty-eight (48) consecutive hours (excluding scheduled maintenance or force majeure). Pricing may change on thirty (30) days' prior notice. ## 4. User-Generated Content and Proprietary Rights You retain ownership of strategies, data, or content you submit ("User Content") but grant the Company a perpetual, worldwide, royalty-free, sublicensable license to use it in connection with the Services, including AI training (anonymized where feasible). The Company owns all rights in the Services, including the Aisha AI assistant, algorithms, and platform outputs. Reverse-engineering or circumventing technological measures is a material breach. ## 5. Prohibited Conduct and Usage Restrictions You agree not to: (i) violate laws or regulations; (ii) engage in market manipulation, unauthorized access, or denial-of-service attacks; (iii) transmit malicious code or spam; or (iv) infringe intellectual property or privacy rights. ## 6. Termination and Suspension Rights The Company may suspend or terminate access at any time, with or without cause, including for suspected abuse or non-payment. Survival clauses (indemnity, liability limitations) remain in effect post-termination. ## 7. Disclaimer of Warranties The Services are provided "as is" and "as available," without warranties of any kind. Beta features are experimental and provided without additional assurances. ## 8. Limitation of Liability and Indemnification To the fullest extent permitted by law, the Company is not liable for indirect, incidental, special, consequential, or punitive damages. Aggregate liability shall not exceed the total fees paid by you in the twelve (12) months preceding the claim. You agree to indemnify and hold harmless the Company from claims arising from your use of the Services or violation of these Terms. ## 9. Force Majeure The Company is not liable for delays or failures caused by events beyond reasonable control, including acts of God, cyberattacks, market disruptions, or regulatory changes. ## 10. Governing Law and Dispute Resolution These Terms are governed by the laws of British Columbia, Canada. Disputes are resolved through binding arbitration in Vancouver under the rules of the British Columbia International Commercial Arbitration Centre. Nothing herein limits EU users' rights under the GDPR or consumer protection laws. ## 11. Modifications to Terms We may amend these Terms at any time, providing notice via email or platform announcement. Continued use constitutes acceptance. ## 12.
